CJP Protest Brings Delhi to a Standstill as BJP Accuses Opposition of Political Destabilisation

The debate between the Bharatiya Janata Party (BJP) and the Cockroach Janta Party (CJP) around electoral roll revision has now become a huge political and security controversy, and the government has restricted all activities in the city of New Delhi, it has sent preventive detentions and there are serious concerns about how far democratic protest can go. The demand for the resignation of Chief Election Commissioner Gyanesh Kumar has now turned into a bigger issue of electoral credibility, public order, opposition mobilisation and the economic damage to be caused to the national capital if it is dragged into a dispute.


BJP parliamentarian Jagdambika Pal said that CJP organisers were trying to "take over Delhi" on the false excuse that they were opposing the Special Intensive Revision (SIR) of electoral rolls. Speaking in Siddharthnagar, UP, Pal said that the agitation was politically motivated and thus it had caused an unnecessary trouble to the common man. He contended that the Election Commission's verification exercise was necessary to ensure that voters who had died had been eliminated and that no duplicate voters were included in the electoral register.


His actions are in line with the main argument of ruling party; that electoral reform is not to be blocked by street mobilisation. Sambit Patra, a spokesperson for the BJP, also called the agitation futile and said that it was an attempt to cause disruptions and not to solve the problem in a democratic way.


But the conflict is not just a battle of political parties. Its core is a question that must be balanced: how can India fulfill its duty to ensure public safety, commercial activity, and critical infrastructure be protected in the face of the constitutional right to peaceful gathering?


CJP had earlier announced a demonstration at Jantar Mantar on October 10 that called for the resignation of Kumar and doubts about the integrity of the voter-list revision. Its planners say it could exclude valid voters and have an impact on elections. The Election Commission and the Bharatiya Janata Party dismiss the charges of a deliberate attempt to manipulate and say that verification is an administrative procedure.


Later, it was realized the scale of the confrontation when Delhi Police had declined to grant permission for the assembly due to “problems” in the assembly procedure and past instances of failure to comply with the orders. The Ministry of Home Affairs then requested the coordination between the State governments and Delhi Police to avoid unauthorised mobilization.


Security was deployed in most parts of central Delhi. The movement around key areas of government and business was impacted by barricades, traffic diversions, and Metro access restrictions and preventive deployments. Published estimates were so widely divergent that no single count is considered a true figure for the number of detainees, though reports during the day were in the thousands.


The activists, including CJP activist Abhijeet Dipke, who had arrived in Delhi, were among the detainees. Its supporters said the police reaction was a "huge curtailment of political speech. Police said permission had been refused and precautions must be taken to prevent disturbances.


The economic impact is worth considering as Delhi is not just the administrative hub of India. It is a significant services economy that services corporate headquarters, financial institutions, hospitality, retail, transport operators and thousands of small businesses that rely on the uninterrupted movement of people.


Normal business at shops, offices and hospitality units was hampered as a result of the restrictions at Connaught Place, one of the most valuable commercial districts in the capital. Hotels report being told they can not accept rooms and businesses are getting the word out to close their doors to report illustrates how security decisions can quickly impact economic activity beyond the protest site.


A small retailer may lose out on significant amounts of trading if he or she loses a Saturday. Restaurants lose revenue due to cancelled reservations, perishables going bad, and decrease in customers. Transport operators face route diversions, increased fuel costs and lost working time. Delays for office workers and those providing services that impact the day's productivity.


An independent monetary estimate of the disruption of 10 October has not been established. If we were to give a precise rupee figure without having any transaction, mobility and business data, then it would be speculative. The economic impact of restrictions is, however, clear: limited access leads to fewer customers, more operating expense.


The broader election controversy also has economic consequences. The institutional predictability is critical to India's ability to draw long-term investment in the domestic and global capital markets. In addition to the factors of taxation, infrastructure and consumer demand, businesses weighing expansion decisions also consider factors such as regulatory stability, administrative credibility, and institutions' ability to resolve disputes without lengthy disruptions.


But to say that the protest of one particular day will harm India's investment prospects is false. Investors make a clear separation between political turbulence and institutional uncertainty. If there was a regular escalation in the level of conflict, then the concern would be the impact that this would have on the ability to effectively transport people, conduct business and/or on the trust placed in the electoral administration.


But the controversy surrounding SIR must be more than political jingoism. Voters' registers are crucial for a credible election. Eliminating duplicate votes and determining voter deaths can be valid administrative goals. Also, the verification process needs to include clear procedures, notice and remedies for eligible citizens whose names have been removed wrongly.


The mere fact that a lot of entries have been deleted or changed does not automatically prove electoral fraud. The election commission's statutory power is no reason to stop scrutinising it. The evidence relevant to this is as follows: the reasons for the deletions, the demographic trend, objections received, and the appeals resolved, as well as the safeguards offered to the genuine voters.


International experience shows that conflicts over electoral administration can turn political when issues of electoral procedures and rules escalate into questions about the trust in institutions. Globally, democracies are experiencing similar challenges of balancing keeping up accurate electoral registers and avoiding the exclusion of ineligible citizens. The answers India will get will come from the strength of evidence, rather than the volume of political rhetoric used.It will not be political rhetoric, it will be the quality of evidence and transparency and enforcement that will determine the response that India gets.


The importance of the government's duty to maintain order is also paramount. Constitutional protection of peaceful protest does not mean that anyone has an unlimited right to disrupt the delivery of goods and services, destroy property or ignore lawful needs of public safety. Proportionality and legally reviewable preventive policing, however, must be the basis of all preventive policing.


Whether either side can prove its case beyond the allegations in the public eye is the key question. The Election Commission has the opportunity to boost confidence by providing easily accessible verification information and good grievance channels. Protest organisers can bolster their case by documenting examples of wrongful exclusion as well as making more general accusations.
